For any H-1B petition, KU is required to pay whichever is higher, the actual wage or the prevailing wage.
The prevailing wage is the average of the rate of wages paid to workers similarly employed in the area of intended employment. The University of Kansas submits prevailing wage requests to the U.S. Department of Labor Prevailing Wage Center. The Department of Labor (DOL) bases their determinations on many factors, which includes, geographic location, discipline, job duties, title, education, supervision, etc. This process takes between 30 and 60 days. Recently, DOL determinations are taking the full 60 day processing time period.
The actual wage is the salary range determined by KU's Human Resource and Equal Opportunity office by comparing other workers in the same position or in positions with similar experience and qualification. A range is determined from that pool of workers. From this range of salaries, various factors (years of experience, education, job responsibilities, publications and specialized knowledge) will determine the actual wage for the position.
